Divorce
Either party to a marriage can apply for a divorce after being separated for 12 months. The separation for that period is evidence of the irreconcilable breakdown of a relationship and no other evidence is required, unless the parties have lived in the same house after separating.
A divorce application is separate from property settlement applications and proceedings.
Applications for divorce are filed in the Federal Magistrates Court. The Family Court no longer accepts divorce applications.
